Abstract

The article is devoted to criminological modeling of the concept of
lustration as an element of transitional justice. The existence of a social demand
for lustration in the context of institutional transformations in the
implementation of transitional justice has been identified and empirically proven.
From the objective point of view, the criminological model of lustration is on the
border of constitutional, administrative, labor, criminal law, and international
human rights law. Lustration in the context of transitional justice for Ukraine
appears as a triplex phenomenon, combining criminal-legal, political-legal and
political segments. Each of them is characterized.
