LEGAL PRINCIPLES OF CONCLUDING A CONTRACT FOR THE PROVISION OF MEDICAL SERVICES TO FOREIGNERS TEMPORARILY STAYING IN UKRAINE

Abstract

The article focuses on the specifics of contract agreements for medical
services offered to foreigners temporarily residing in Ukraine. The legislation of
Ukraine does not specifically address contract details for medical service
provision. Medical care for foreign citizens temporarily staying in Ukraine is
provided for a fee; however, the methodology for calculating the cost of medical
services for foreigners has not been approved yet. Healthcare institutions that
offer medical services for a fee must have supporting documents and a written
contract.
Amendments are proposed to Ukrainian legislation regarding contracts for
medical services to foreigners. It is suggested that the Civil Code of Ukraine and
the Law of Ukraine on Tourism should outline the specific provisions for entering
into contracts for medical services and address the unique aspects of medical and
health tourism activities. The proposed Law of Ukraine On the Legal Status of
Foreigners stipulates that medical services for foreigners temporarily residing in
Ukraine are offered on a paid basis. These services will be provided in accordance
with a written contract.
