NON-PUNISHMENT FORCED SANCTIONS FOR COMMITMENT OF CRIMINAL OFFENSES: CONCEPTS AND TYPES

Abstract
The article is devoted to the study of the sanctions of criminal law norms in
the context of their division into coercive and encouraging, given the presence of
various types of criminal law measures in such sanctions. In the process of
scientific research, the emphasis is placed on coercive non-punitive sanctions and
their place in the current criminal law, the possibility of their application for
criminal offenses and possible ways of improving the norms regarding the
application of such sanctions are clarified. The types of coercive non-punitive
sanctions were also distinguished by the nature of the influence measures,
depending on the type of criminal-legal measures contained in such sanctions.
The author also analyzed the statistical information regarding the percentage of
the use of non-punitive coercive sanctions during the consideration of criminal
proceedings.
