TRAFFICKING IN HUMAN BEINGS DURING WAR IN UKRAINE AS A CRIMINOLOGICAL PHENOMENON

Abstract

The article is devoted to the formation of a criminological understanding of
the phenomenon of human trafficking in the conditions of the Russian-Ukrainian
war. The dependence of the intensity of reproduction of these criminal practices
on the factor of migration and increased vulnerability of persons moving within
the country and abroad has been established. Two groups of human trafficking in
war conditions are identified and characterized: ordinary and war-contextual. It
was emphasized that there is an urgent need to improve the current legislation on
criminal liability and the practice of its application regarding the correct
qualification and investigation of the relevant acts as crimes against humanity (de
lege ferenda) and genocide. The problem of identifying and investigating the facts
of trafficking in people and the temporarily occupied territories of Ukraine, as
well as prisoners of war, is also relevant.
