FORENSIC SUPPORT FOR CONDUCTING AN INVESTIGATIVE EXPERIMENT DURING THE INVESTIGATION OF CRIMINAL OFFENSES AGAINST MORALITY

Abstract

The article is devoted to the consideration of some aspects of the
investigation of criminal offenses against morality. The peculiarities of conducting
an investigative experiment in criminal proceedings of a certain category are
analyzed.
It is noted that the investigative experiment is an important procedural
action in any categories of criminal proceedings. Because thanks to its
implementation, one of the main tasks of the investigation can be solved: whether
the criminal offense was really committed as it appears in the testimony of the
interrogated person. During the investigation of criminal offenses against
morality, the specified investigative (search) action does not lose its weight,
because in the vast majority of situations there is a need to check the statements
of the suspect, victim or witness. The following measures of the preparatory stage for conducting an
investigative experiment in the investigation of criminal offenses against morality
have been established, such as: preliminary interrogation of the person whose
testimony will be checked; complete and detailed processing of criminal
proceedings materials; preparation of technical and forensic means; selection of
vehicles; selection of participants in the procedural action; ensuring security
during the procedural action; carrying out operational and search activities with
the aim of obtaining additional information about the situation and circumstances
of the event; selection of additional means necessary during the investigative
experiment; drawing up a plan of an investigative experiment; preliminary
inspection of the territory (premises) where the procedural action is expected.
It was found that repeated questioning allows to find out the following
circumstances, in particular: circumstances that need to be verified by conducting
experiments or tests; to update information in the memory of persons involved in
conducting an investigative experiment; to reveal the motives of the suspects
giving their consent to participate in the investigated procedural action; establish
the type of investigative experiment; determine the range of tasks to be set; to
make a decision regarding the conduct of a procedural action.
The most optimal conditions for conducting an investigative experiment in
criminal proceedings of the studied category have been determined, such as:
implementation of an investigative experiment in an environment as close as
possible to the one in which the illegal event took place; activating the memory of
the person whose testimony is being checked; establishing and maintaining
psychological contact with the offender, as well as observing his behavior;
multiple repetition of homogeneous experiments in variable circumstances; the
best limitation of the number of participants in the procedural action.
