TO THE ISSUE OF THE LEGAL BASIS FOR THE PROVISION OF TERRITORIAL DEFENSE BY LOCAL STATE ADMINISTRATIONS IN UKRAINE

Abstract

The article emphasizes that legal regulation has a general educational
impact on society, it is inseparable from the moral and ethical foundations of
society, in particular, we would like to emphasize the close relationship with the
phenomenon of honor. Legal regulation has long had close relationships with religion, the relationship of man to pious beings
It is emphasized that administrative-legal regulation serves as the
organizational-management basis for the successful implementation of any
process of a public-legal nature of the norm, ensures the efficiency and
effectiveness of a specific administrative form, method and procedure.
It was determined that the fundamental principles, inviolable foundations
of ensuring the territorial defense of Ukraine are defined at the level of the
Constitution of Ukraine; at the international level of legal frameworks, attention
was paid to the provisions of the European Convention on Human Rights and the
Convention on the Protection of the Civilian Population in Time of War;
provisions of domestic legislation were analyzed, in particular the Law of Ukraine
"On the Foundations of National Resistance", the Law of Ukraine "On National
Security of Ukraine", the Law of Ukraine "On the Defense of Ukraine", the Law of
Ukraine "On Military Duty and Military Service", the Law of Ukraine "On Social
and legal protection of military personnel and members of their families", the Law
of Ukraine "On mobilization training and mobilization", the Law of Ukraine "On
the legal regime of martial law"; the decrees of the President of Ukraine approving
the Strategic Defense Bulletin of Ukraine and the National Security Strategy of
Ukraine, resolutions of the Cabinet of Ministers of Ukraine were analyzed at the
level of subordinate legal acts; at the grassroots level, the orders of the head of the
Khmelnytskyi regional military administration in the area of territorial defense
were analyzed.
