PRINCIPLES OF REINTEGRATION OF THE TEMPORARY OCCUPIED TERRITORIES OF UKRAINE: THEORETICAL AND LEGAL ASPECTS

Abstract

The article substantiates the principles of reintegration of the temporarily
occupied territories of Ukraine and the prospects for its legal consolidation.
In the process of legal regulation of the mechanism for restoring the
territorial integrity of the state, it is important to establish the leading principles
of reintegration of the temporarily occupied territories of Ukraine.
It was determined that the principles of reintegration of the temporarily
occupied territories of Ukraine are guiding, fundamental ideas and values that
underlie the relevant process. They are the basis for the formation of state policy
on the reintegration of de-occupied territories and contribute to ensuring justice
in this process.
The proposed general principles of reintegration of the temporarily
occupied territories of Ukraine include: the rule of law and legality, democracy,
humanism, efficiency, effectiveness and expediency, transparency and openness,
reasonableness, planning, coordination, predictability, consistency, etc.
The special principles of reintegration of the temporarily occupied
territories of Ukraine can be defined as: the principle of priority of national
interests; the principle of responsibility of the Ukrainian state for reintegration
and its results; the principle of compliance with the principles and norms of
international law in the process of reintegration; the principle of fairness and
impartiality; the principle of urgency and urgency; principle of synchronization;
the principle of prioritizing community development; the principle of non-
violence; orientation to the interests of the population; non-discrimination and
ensuring inclusiveness; prevention of re-occupation; application of the concept of
transitional justice; involvement of civil society institutions and international
organizations.
The process of reintegration of the temporarily occupied territories of
Ukraine must take place in compliance with international standards of human
rights and the rule of law. . The principles of reintegration of the temporarily
occupied territories of Ukraine require further comprehensive research,
especially considering the international experience of their implementation.
