МІЖНАРОДНИЙ ВИМІР ПРАВОВОЇ ОЦІНКИ ЗЛОЧИНУ ГЕНОЦИДУ В КОНТЕКСТІ АГРЕСІЇ РОСІЙСЬКОЇ ФЕДЕРАЦІЇ ПРОТИ УКРАЇНИ

Abstract

The article analyzes peculiarities of legal evaluation of the crime of genocide
at national and international levels in the context of aggression of the Russian
Federation against Ukraine. Based on the analysis of scientific positions and
international judicial practice the author substantiates the position about greater
gravity of the crime of genocide among other international crimes. Within the
context of prosecuting high authorities of the Russian Federation for crimes
committed in Ukraine the author warns against substitution of the charges in the
genocide and military aggression with charges in war crimes. The article stresses
the need of comprehensive, correct and consistent translation of international
agreements dealing with criminalization of international crimes, including the
crime of genocide. The conclusion was drawn about urgency of elaboration of
coherent and effective strategy for prosecuting the crime of genocide in the
context of aggression of the Russian Federation against Ukraine.
