INSTITUTIONAL REFORM AS A COMPONENT OF TRANSITIONAL JUSTICE: A NEW PERSPECTIVE IN THE CONTEXT OF THE RUSSIAN- UKRAINIAN WAR

Abstract
In the article, based on the results of theoretical and empirical research, an
attempt is made to conduct a criminological and social analysis of one of the
elements of transitional justice, which is institutional reform. Institutional reform
is considered from a somewhat «new» perspective that does not fit into the
traditional paradigm regarding the structure and content of this activity. The
concepts of institutional and institutional reform are compared. Arguments are
presented indicating that the latter is broader than the former. The results of a
survey of five groups of respondents, which formed the basis for building the
system of institutional reform in Ukraine, are presented. Two levels of the latter
are distinguished: global (international) and national. Their content is revealed,
and specific measures to be implemented at these levels are highlighted. The
principles that should form the basis of institutional reform and on which its
effectiveness depends are indicated.
