SEXUAL VIOLENCE RELATED TO THE CONFLICT: A CRIMINOLOGICAL ANALYSIS OF THE SITUATION IN THE CONTEXT OF THE RUSSIAN- UKRAINIAN WAR

Abstract
The article is devoted to a criminological analysis of conflict-related sexual
violence (CSV) in the context of the Russian-Ukrainian war. It has been
established that it is a common, but highly latent type of crime. From the
perspective of criminal law characteristics, they are mostly classified as war
crimes. However, from the point of view of criminal law policy and taking into
account the provisions of international criminal law, in a number of cases there
are reasons to talk about crimes against humanity. These are cases of large-scale
or systematic application of the SNPK as an element of the policy of the aggressor
country in the occupied territories of Ukraine. The victims of the SNPK are both
civilians and military personnel. Sexualized forms of torture of Ukrainian
prisoners of war are common: rape, threats of rape and castration, infliction of
physical blows or electric shocks on the genitals, forced nudity.
