REGARDING THE NEED TO AMEND THE INSTRUCTION ON THE ORGANIZATION OF COVERT INVESTIGATIVE (SEARCH) ACTIONS AND THE USE OF THEIR RESULTS IN CRIMINAL PROCEEDINGS

Abstract

The article provides a detailed examination of the Instruction on the
organization of covert investigative (search) actions and the use of their results in
criminal proceedings, analyzing its inconsistencies with current Ukrainian
legislation, particularly the Criminal Procedure Code of Ukraine. Discrepancies
were identified regarding the entities authorized to conduct such actions, the
current names of specific actions, their forms of implementation, as well as
procedural requirements for their organization. A number of changes to the
Instruction were proposed, including updating terminology and clarifying the
procedure for conducting certain investigative actions in accordance with new
legislative requirements. The proposed changes aim to align the Instruction with
the Criminal Procedure Code of Ukraine and ensure the effective conduct of covert
investigative actions.
