FOREIGN EXPERIENCE OF ENSURING THE IMPLEMENTATION OF MEASURES OF THE LEGAL REGIME OF MARTIAL LAW AND THE POSSIBILITY OF ITS USE IN UKRAINE

Abstract

The article emphasizes that the successful implementation of martial law
measures in foreign countries is often based on harmonious coordination
between state bodies, military structures and civilian enterprises, institutions and
organizations. This highlights the importance of integrating military and civilian
strategies to ensure overall security and stability during crisis situations.
It was noted that foreign experience shows the need to ensure a proper balance between ensuring security and protecting the rights and freedoms of
citizens. Countries that effectively manage the implementation of martial law
measures usually have control and oversight mechanisms that prevent abuse and
ensure compliance with the rule of law, even under conditions of emergency.
It is argued that it is important for Ukraine to consider the specifics of
national conditions and the socio-political situation when implementing foreign
experience. In particular, it is necessary to develop institutions responsible for
operational coordination of various bodies and units under martial law, as well as
to improve legislative mechanisms to ensure legal protection of citizens during
martial law.
It is emphasized that the adaptation of foreign experience in Ukraine can
significantly increase the effectiveness of the implementation of measures of the
legal regime of martial law, but it requires careful analysis and consideration of
national characteristics. The implementation of the best foreign practices and
their adaptation to Ukrainian conditions will be a guarantee not only of increasing
the country's defense capabilities, but also of ensuring legal and social stability in
emergency situations.
