EVOLUTION OF LEGISLATIVE REGULATION OF PUBLIC PROCUREMENT OF MEDICINES IN UKRAINE: FROM THE FIRST REGULATIONS TO THE PRESENT DAY

Abstract
The article analyzes the development of the public procurement system for
medicines and medical devices in Ukraine in the historical context, with a focus on
current changes caused by the war. The article examines the key stages of
formation and improvement of the regulatory framework, starting with the first
attempts at centralized regulation at the beginning of independence to the
introduction of modern mechanisms, such as the ProZorro electronic
procurement system.
The main difficulties and achievements at each stage are revealed,
illustrating the transition from the centralized Soviet model to an open and
competitive procurement system focused on ensuring transparency and
accessibility of medicines for the population.
The article concludes that the development of the public procurement
system for medicines in Ukraine has been characterized by constant adaptation to
new economic, political and social challenges. The evolution of legal regulation
aimed at transparency and competition has created the basis for the efficient use
of public resources, but at the same time has shown the need for continuous
improvement, especially in crisis situations. The war has demonstrated the
importance of a flexible approach to public procurement that maintains high
quality and availability of medicines but is adapted to emergency conditions.
Further research on this topic is relevant for the development of effective
mechanisms of legal regulation in the context of constant transformation of the
healthcare system and economic realities.
