ILLEGAL ACTIVITIES OF PROFESSIONAL PARTICIPANTS' LITIGATION AS AN OBJECT OF THE SCIENTISTS AND INVESTIGATORS' COGNITIVE ACTIVITY

Abstract

The article determines that the cognitive activity of an investigator is
complex and retrospective, and is also associated with the use of several forensic
tools to collect evidence, which in the end (after its verification and evaluation)
will be the basis for the relevant procedural decision. Detection and investigation
of criminal offenses against justice committed by professional participants in
judicial proceedings are, as is justified, the most complex areas of activity since
their commission is mainly carried out by officials, in particular, investigators,
inquirers, prosecutors, employees of operational units, etc., that is, persons whose
level of awareness in the methods and specifics of criminal procedural activity is
professional, and therefore can be used in matters of countering the investigation.
Based on the analysis of statistical indicators, it was established that law
enforcement activities need to be improved, particularly in implementing
approved investigation methods, which the scientific community has not yet
developed. It is emphasized that scientific research should pay attention to a
thorough study of the forensic characteristics and classification of criminal
offenses committed by professional participants in the judicial process, the
typification of investigative situations that are formed at all stages of the
investigation of criminal violations of this type, investigation algorithms, tactical
recommendations for conducting investigative (detective) actions and using
special knowledge, means of overcoming resistance to the investigation of crimes
of this group.
