SCIENTIFIC DEVELOPMENT OF THE PROBLEM USING SPECIAL KNOWLEDGE DURING THE INVESTIGATION OF CRIMINAL OFFENCES IN THE ECONOMIC ACTIVITY SPHERE

Abstract

The article, based on the generalization of several theoretical developments
carried out within the framework of legal and economic sciences, states that
Ukrainian scientists develop, improve, and develop scientific provisions within
the framework of the problems of using special knowledge during the
investigation and trial of criminal offenses in the sphere of economic activity. It is
found that several theoretical provisions developed over the past twenty years
relate to the general principles of using special knowledge in criminal proceedings
or to individual industry principles, such as the participation of a specialist in
subsequent (detective) actions or the involvement of an expert in conducting a
certain type of expert research. It was determined that the issues of using special knowledge during the investigation of smuggling, countering economic activity,
bringing to bankruptcy and insolvency of a bank, manipulation in the energy and
organized market, disclosure of commercial, banking, and insider information,
and criminal offenses related to privatization. and associated with the circulation
of securities are unexplored.
It was determined that the state of scientific development on the issue of
using special knowledge during the investigation of criminal offenses in the field
of economic activity and their judicial review is insufficient. In the theory of
domestic science, only its individual components were mainly studied, and
therefore, activation is required. Directions for further scientific research are
outlined.
