REGULATORY AND LEGAL BASIS OF PROFESSIONAL TRAINING OF POLICE OFFICERS IN UKRAINE

Abstract

It is emphasized that on the pages of professional scientific literature, the
main attention is paid to the legal regulation of police activities in general, while
the regulatory and legal foundations of professional training of police officers are
not sufficiently studied. An analysis of the approaches of legal scholars to
understanding the essence and significance of the regulatory and legal
foundations of the functioning of the relevant sphere of public life was carried out.
Taking this into account, the author's vision of understanding the essence of the
regulatory and legal foundations of professional training of police officers was
formed. It is proved that in general, the current national legislation, including
regulatory and legal acts regulating the issues of professional training of police
officers, have recently undergone significant changes, both in view of the desire of
our state to comply with recognized world standards and in view of the
introduction of the legal regime of martial law. It is substantiated that the analysis
of regulatory and legal acts on the basis of which professional training of police
officers in Ukraine is carried out will allow identifying shortcomings and
legislative gaps in this area of public relations, which can be taken as a basis for
improving such legislation.
An analysis of regulatory legal acts regulating the issues of professional
training of police officers was carried out, taking into account the legal force of a
separate act of the following acts - from the highest legal force to the lowest: the
Constitution of Ukraine, international treaties of Ukraine, laws of Ukraine,
subordinate regulatory legal acts. It was proved that, given the number of subjects
of the issuance of subordinate regulatory legal acts regulating the issues of
professional training of police officers, they can be presented as a separate system
in total. It was established that the subjects of the issuance of subordinate
regulatory legal acts, the provisions of which regulate the issues of professional
training of police officers are: the President of Ukraine, the Cabinet of Ministers of
Ukraine and the central executive bodies - the Ministry of Education and Science
of Ukraine and the Ministry of Internal Affairs of Ukraine.
