ENSURING THE POPULATION’S ACCESS TO HOUSING AS AN ELEMENT OF THE RECONSTRUCTION OF UKRAINE UNDER THE MARTIAL STATE

Abstract

The article is devoted to determining the current state of ensuring the
population’s access to housing as an element of the reconstruction of Ukraine
under martial law. It is emphasized that the right to housing is guaranteed by the
norms of national and international legislation, namely the Constitution of
Ukraine, the International Covenant on Economic, Social and Cultural Rights, the
European Social Charter, the European Convention on Human Rights. Taking into
account that housing under any conditions is one of the main material goods
necessary for the successful organization of human life, ensuring the population’s
access to housing is one of the social obligations of the state, especially in
conditions of martial law, when it is the housing sector that suffers significant destruction, which is confirmed by statistical data. It is noted that despite the
continuation of the war in Ukraine, active work is already underway to restore the
infrastructure, primarily to ensure the population’s access to housing. It is
proposed to understand the set of elements that contribute to ensuring the short-
term and long-term housing needs of the population affected by the war, in
particular: the provision of temporary housing; providing the most vulnerable
categories of the population with housing; reconstruction of the destroyed
housing stock; construction of new affordable housing; financial support
programs for the population; simplification of permit/registration procedures in
the construction and related industries taking into account the conditions of
martial law; use of technologies to increase the energy efficiency of housing,
taking into account environmental standards; involvement of the public and
cooperation with international organizations. It was emphasized that the
continuation of the Russian Federation’s military aggression will increase the
destruction of the housing sector of the state, accordingly, updating the principles
of the state housing policy of Ukraine should become the main one for ensuring
the population’s access to housing in conditions of martial law and further
reconstruction in the post-war period.
