LEGAL REGULATION OF URBAN PLANNING ACTIVITIES IN UKRAINE

Abstract

The article is devoted to the study of the issue of legal regulation of urban
planning activities in Ukraine. The article analyzes the main regulatory legal acts
that regulate urban planning legal relations, identifies the shortcomings and
advantages of urban planning legislation, defines the main provisions that
regulate the above-mentioned legal relations. The article examines the
characteristic features of permitting procedures in the field of urban planning in
Ukraine, determines the need for regulation of such procedures through
standardization and certification, identifies the opinions of scientists in support of
such theses, and also notes the problem of legislative regulation of the sphere as a
whole, which implies the need for effective legislative regulation, regulation at the
level of subordinate regulatory legal acts, including regulation of interaction of
units of state authorities in this area, etc. The article identifies a number of advantages and disadvantages in the context of legislative consolidation of
permitting procedures and their implementation in the field of urban planning in
Ukraine. The scientific article contains a phased analysis of the regulatory
regulation of urban planning activities in Ukraine. The article contains
information on the need to create favorable conditions for companies engaged in
urban planning activities in Ukraine, because the real estate market today affects
both the economic level of development of the state and the stability of the
currency in the state, especially during the period of the legal regime of martial
law. The article identifies the shortcomings of the regulatory regulation of urban
planning activities in Ukraine, and indicates a list of problematic issues that were
analyzed within the framework of this scientific article. The article provides
proposals for improving the legal regulation of urban planning activities in
Ukraine. It is noted that the transparency of administrative procedures in general
and permitting procedures in particular in the field of urban planning draws
attention to such a direction of management of the permitting system as its
internal organization in accordance with the current public demand, which can be
considered as one of the directions of public administration in this area, and
internal management of the team is determined by the inherent function of the
manager (both linear and functional management).
