LEGAL PRINCIPLES OF PROFESSIONAL TRAINING OF PERSONNEL OF THE SECURITY SERVICE OF UKRAINE

Abstract

The article proposes to understand the legal basis of professional training of
SBU personnel as a set of regulatory and legal acts that, taking into account the
legal force of an individual one, establish the rules of conduct of subjects of public
relations that arise and develop in connection with the implementation of
professional training of SBU personnel. It has been found that today we can name
a fairly significant number of regulatory and legal acts that, in their entirety, will
constitute the legal basis for the functioning of the studied sphere of public
relations. In general, such regulatory and legal acts can be represented as a certain
system, an independent element of which will be a separate one of such acts, and its system-forming link is its legal force. An analysis of the legal basis of
professional training of SBU personnel has been carried out, taking into account
the legal force of an individual regulatory and legal act. The legal principles of
professional training of SBU personnel are identified and characterized according
to several criteria: 1) depending on the legal force - the Constitution of Ukraine;
international treaties of Ukraine; laws of Ukraine, codified legislation; subordinate
regulatory legal acts; 2) depending on the subject - those adopted by: the
Verkhovna Rada of Ukraine; the President of Ukraine, including by enacting
decisions of the National Security and Defense Council; the Cabinet of Ministers of
Ukraine; the Ministry of Education and Science of Ukraine; the SBU, including
jointly with other subjects; 3) depending on the sphere of regulatory and legal
regulation: acts that establish the general legal principles of professional training
of SBU personnel; acts that determine the legal status of subjects of professional
training of SBU personnel; acts that regulate individual areas of professional
training of SBU personnel; acts whose action is aimed at ensuring professional
training of SBU personnel in individual areas; acts that determine the legal
principles of professional training of SBU personnel on a wide variety of issues. It
is emphasized that a special place among the legal principles of professional
training of SBU personnel is occupied by regulatory and legal acts, on the basis of
which administrative and legal regulation of this sphere of social relations is
carried out.
