Abstract

The article examines the theoretical and legal foundations of the activities of
investigative units of the security agencies of Ukraine in collecting evidence by
conducting covert investigative (search) actions. Based on a critical analysis of the
approaches existing in the scientific literature, the author's approach to
understanding the concept of collecting evidence by investigators of the security
agencies of Ukraine is formulated. It is determined that conducting covert
investigative (search) actions is one of the ways of collecting evidence by
investigators of the security agencies of Ukraine, along with such as: investigative
(search) actions, measures to ensure criminal proceedings, requesting and
obtaining evidence from individuals and legal entities. The conclusion is formulated
that covert investigative (search) actions are of an auxiliary and exclusive nature in
proving, which is due to the possibility of their conduct only in cases where
collecting evidence through conducting covert procedural actions cannot ensure
the implementation of the goal of collecting evidence. It is noted that they are a
significant means of collecting evidence in the activities of investigative security
bodies of Ukraine, given the criminal-legal and forensic characteristics of the
crimes they investigate.
