PRACTICAL ASPECTS OF ENFORCEMENT OF RESTRICTIVE ORDERS AGAINST ABUSERS AS A LEGAL CONSEQUENCE OF DOMESTIC VIOLENCE

Abstract
The article examines the actual problems of practical implementation of a
restrictive order as a tool for combating domestic violence. The mechanisms of
removal, execution and control over compliance with restrictive regulations by
abusers are analyzed. Particular attention is paid to the legal nature of a
restrictive prescription and its double nature as an administrative-legal and civil-
legal institution. The article also emphasizes the detection of gaps in legislative
regulation and law enforcement practice, which reduce the effectiveness of
victims from domestic violence. The main problems of implementation of
restrictive prescriptions are established: violation of the terms of consideration
by the courts of cases of issuing a restrictive order, failure to notify the decision
on the restrictive prescription of police, the imperfection of the mechanism of
monitoring their implementation, insufficient coordination between the subjects
of interaction in the field of restriction. A set of measures to improve the efficiency
of restrictive regulations, in particular, improving the legislative framework and
strengthening of interagency interaction, is proposed.
