INVESTIGATIVE (SEARCH) ACTIONS AS A METHOD OF VERIFYING EVIDENCE IN CRIMINAL PROCEEDINGS UNDER THE CONDITIONS OF THE LEGAL REGIME OF MARTYR STATE

Abstract
The article is devoted to the study of the essence and place of individual
investigative (search) actions in the system of procedural methods of verifying
evidence in criminal proceedings under martial law. Attention is focused on the
fact that the conduct of criminal proceedings related to martial law is a relatively
new area of scientific research. A detailed analysis of the provisions of the Code of
Criminal Procedure of Ukraine regulating the features of the conduct of individual
investigative (search) actions under martial law is carried out, in particular,
regarding the simplification of the procedural procedure for their conduct. It is
determined that such investigative (search) actions as an investigative
experiment, conducting an examination, using testimony during evidence under
the legal regime of martial law, for the most part, cannot be carried out under the
general conditions provided for by criminal procedural legislation. Proposals are
made to improve criminal procedural activities aimed at the effectiveness of pre-
trial investigation, observance of the rights and freedoms of participants in
criminal proceedings.
