ADMINISTRATIVE AND LEGAL STATUS OF THE STATE EMPLOYMENT SERVICE

Abstract
The article, on the basis of current legislation and analytical reports, defines
a set of problems that currently exist in relation to the realization of the right to
work, including: a significant level of unemployment, low-paid work, a high share
of unofficial or unstable work, not isolated facts of discrimination and restrictions
on access to jobs and career opportunities, long-term military aggression. It was
determined that in order to implement the state policy in the field of population
employment and labor migration, social protection against unemployment, it is
necessary, first of all, to understand the role and place of the bodies that must
implement this policy, as well as their administrative and legal status. It was
established that the Centralized system of state institutions, which implements
state policy in the sphere of population employment and labor migration, social
protection against unemployment, is the State Employment Service, which is
currently coordinated by the Ministry of Economy of Ukraine.
It was concluded that the administrative and legal status of the Service is
constantly in a dynamic process that changes it both externally and internally.
Variables are the general functional bases of the Service’s activity, which are
specified by specific directions of the optimizing context. However, it is important
that until the Soviet-type system of forming its functionality is fundamentally
changed (it is about completing the process of its formation as a service that not
only has the appropriate powers, but also meets this task in the social aspect), it is
useless to talk about the effectiveness of the normatively created conditions for
sustainable economic growth of Ukraine and implementation of the main
direction of state policy on creating decent working conditions and overcoming
unemployment. That is, it should be primarily ensured that its social and
functional compliance with modern requirements and standards in the field of
employment and social protection of employees (updating the personnel
resource, in particular in the way of improving qualifications or ensuring that the
qualifications of employees correspond to the positions held, development and
implementation of new programs and tools to support employment, etc.) , its
flexibility in solving tasks and responding to socio-economic changes.
