«FORESTRY CRIMINALITY» AS A CRIMINOLOGY PHENOMENON: CONCEPTS, SIGNS, TRENDS OF REPRODUCTION

Abstract

The article is devoted to a criminological analysis of the phenomenon of
criminality in the field of forestry («forestry criminality»). It has been established
that the criminal exploitation of forests is a meta-complex political-economic,
institutional phenomenon. From a criminal-legal perspective, it is expressed in
the system of criminal offenses, the characteristics of which are provided for by
various articles of the Criminal Code of Ukraine: from criminal offenses against
the environment to crimes in the sphere of economic activity, official activity, etc.
From a functional point of view, «forestry criminality» involves the exploitation of
all components of the forest: flora and fauna (including and in particular due to
illegal hunting), as well as the lands of the forest fund. The main trends in the
reproduction of «forestry criminality» are: 1) integration of the political-
institutional and economic-institutional activity component; 2)
institutionalization of secondary, conditional and parasitic criminal practices; 3)
redistribution of influence between political and economic actors of forest use
under the influence of the war factor; 4) latentization of «forestry criminality» in
connection with the occupation of certain territories of Ukraine, in particular
parts of the Donetsk, Luhansk, Zaporizhzhia, Kherson regions, and the
Autonomous Republic of Crimea; 5) intensification of damage to the forestry of
Ukraine as a result of hostilities caused by forest fires.
